Angry Has anyone started action against West Side Village (the UK agent)?

It is interested (and disappointing) to see how many other people have an issue with the UK agent as every time I take them to task over their misrepresentations they imply I am the only one.

They have sent me the same verbatim response others have quoted in this forum (ie due dilligence etc, .... not responsible for third party information etc). Well excuse me - isn't that an important part of what agents earn their fee for?

My response was to point out that the developer has seemingly never offered a kitchen or fitted wardrobes and that the West Side Village website is the ONLY source of this information. I have also allowed them the opportunity to provide the source of this mis-information. In the absence of any response I suggested that English law does not allow companies to hide behind 'third party' disclaimers for information they have generated entirely themselves. For the second time their sales director has declined to reply and declined to provide the requested details of the company Chairman/CEO.

I would be interested in joining forces with others seeking to claim compensation for this blatant mis-selling.

well if you're looking for details of CEO's / registered addresses etc. then i would ask Seddons for that indicating that you intend to sue

it would be a good acid test of whether Seddons are actually representing our own best interests as their 'clients' or whether as I currently suspect they are working more in the developer's interest than our own

I agree. Whether the development is a good one or not. There are alot of people who have been misled in their purchase and we should all stand together.
However, I have always found Mustofa at Seddons to be very charming and helpful but I cannot say the same for the manner and tone one of his assistants offers. She quite blatantly reminds me of all the terms and penalties that are in the developers favour every time she calls!

Default Action against WSV

I'm pursuing the final stage with them, ie allowing their highest authority the chance to respond. Following that, and failing a satisfactory outcome, I'll be taking them to court. I will post again when I know their response.

I have just visited the West Side Village website to find that the apartment I am buying is now smaller and with a COMPLETELY different layout. I rang West Side and they said that Seddons should have contacted me because the layouts where changed about 4 - 6 weeks ago.

West Sides's new website also has a section on transparacy and how open they are. As quoted by Stephen Smith: "We wish to hide nothing from our buyers and to make the process as seamless as possible" He has obviously forgotton about the fitted kitchen and wardrobes that they are no longer supplying, free beach access that now may be chargeable.......the list could go on.

I have spoken to Seddons and they said that the developer did send revised plans but they where informed to continue with the original plans. They also said that they understood these plan changes to be minimal and they would not effect any room layouts or square footage. So they have not contacted anyone. Seddons have reassured me that the developer can not make the proposed changes without informing all concerned. I understood that bulding work started earlier this year which would mean the new plans are in place as the revised layout for my apartment is a totally different shape. I also originally had 1 terrace, I now have 2 and they are on a different side of the room to the original plans. Our apartment is in Block B and is a unit 1 - 1 bedroom.

If these new plans are to go ahead we will be seeking major compensation if we still go ahead.
