It is not very clear, but if you have not signed your cheque than the bank should not have paid out. If this the case than you have a claim against the bank under the cheque act.

When you say initials, where were these initial? you normally put initials on a cheque for confirmation of errors &/or alterations.

Who did you make the cheque out to?

If the cheque has been amended (i.e. if you made the cheque out to Joe Bloggs and they then put their Spring Blue stamp on it) then this will constitute an amendment and should not have been processed by your bank unless you had authorised the amendment by your initials. This would also be fraud.

If, however, you did not insert the name of any payee on the cheque then anyone could have inserted their name or company name.

Hiya,
Thanx for getting back I made my cheque out to spring blue furniture
when we got a copy back above were it says furniture they have put their own stamp which is spring blue business SL the cheque was cashed and put into this account.
What I was trying to say is if I ammend cheques I MUST initial it which I have not, all the other people who have been taken by them have had the same done to their cheques. Do you think I have a case?

It is certainly worth pursuing with your bank.

What was the address that you sent the cheque to? Was it in the UK or Spain? Who were you asked to make the cheque out to? Did they forward you a purchase order and if so what name is given there?

I have checked the web site and it does say that Spring Blue Furniture is a trading name of Spring Blue Business SL.

Technically any amendment to a cheque has to be initialled, albeit in this case, it is a small amendment.

The bank could well argue that the cheque was processed by the intended party.

But my advice is to keep pursuing it through the bank's complaints procedure.

Please keep us informed how things progress.

Back from bank no joy there i've asked her to log everything and we are taking it further she says anyone can add to a cheque which we didn't agree with. They say that our arguement is with the spanish bank

Sans: Do not give up with the bank, The bank staff these days are incapable to deal with issues of this nature as they are not trained to further then dishing out email and marketing information for other products.

Make an appointment with the manager and be firm, failing this take them to banks complaints and failing this Banking Ombudsman.

In the mean time pursue other venues that you feel are open to you.

My daughter and I are in the same situation. My daughter paid her half by credit card. She can get her money back, but it will take a couple of months.
I paid by personal cheque, hich was returned to my bank with a request for me to get a euro cheque and lodge it to some spanish bank. Thankfully I didnt. It totally slipped my mind. You have my sympathies. Good luck with quest, and I hope you get your money bcck.

Hi

Yes I have also been caught out by this company. This time in respect of funriture to be delivered to Bulgaria with the promise of a 32" Plasma TV which never materialised. I am currently waiting for my credit card company to refund my account. They were due tio attend the Ideal Home Exhibition in London next month but in view of their recent difficulties it is probable that this has been cancelled. Suggest you check the IHE website.

Incidentlly you may be interested to read the following email which they sent to me earlier this month:-


[I]I am extremely sorry to inform you that due to a legal technicality with my suppliers , no Furniture will be installed at the moment,

Our legal team is meeting on the 19th Febuary 2008 to come to a solution to this matter. At this moment we cannot provide or refund any orders, until

The matter has been resolved by them.

I understand that this will come as a shock and be extremely disappointing , especially since I understand that you may have made travel

Arrangements. Please accept my apologies at this time and please understand that this matter is out of my control. I will endevour to contact you

Personally by telephone to explain the situation , but at this moment please be patient .

If at this stage you decide you wish to cancel your order then i can suggest that you contact your credit card company using this email as proof that

Your order has not been delivered and obtain a refund directly from them, as due to your legal process we cannot refund you directly until this matter is resolved.



I am extremely sorry for any stress and inconvenience we have caused and i will contact you shortly.
