Default Solicitor fees for selling in Spain

Hi there, could anyone provide some guidance on what would be reasonable solicitor fees for selling a property in Spain? My mother in law wants to sell up following the death of her husband, having lived there for 3 years.She has been quoted 3% of sale price, which seems a lot? We have a private buyer in the UK so do not need to involve an estate agent.Thanks.

Hi Mellsbells,

I cannot see why you should be paying 3%! The norm is 1%, even possibly less!! When we sold a property in Spain we paid 0.75%

Yes, 1% would be the average Solicitor fees in Spain

Not sure where you are but the Lawyer we recommend on the Costa Blanca charges a fixe fee of 500 Euros.

The figure you have quoted (3%) is excessive it is solely represents fees for conveyancing. Our typical fee for a sale starts from 750 euros + IVA but some firms will charge a good deal more.

Nonetheless, due to the fact that it is so high it may possibly be explained by the fact that the sale is pursuant to a death and as such the estate must be administered. Fees for this can be higher than conveyancing (for example 3% of the value of the estate) so this may explain this figure.

Hopefully this is of some assistance and should 3% solely represent the conveyancing services I would recommend that you instruct someone else.

The usual fee is 1% of the purchase price and they should take care of everything including the paperwork for your NIE numbers and everything involved on a sale!!!!!

There isn't a lot of work involved for the lawyer representing the seller (there is more work on the buyer's side) so you shouldn't really be paying more than 1000 Euros. She will already have an NIE number from the original purchase. The death of her husband might complicate things a bit, particularly if he did not make a Spanish will (his British will need to be translated and apostilled etc). Even so 3% is way to much.
